TI Lithuania advocates for stronger legal protection and the creation of a friendlier workplace environment for whistleblowers. In 2009, TI Lithuania, in partnership with the law expert Dr. Petras Ragauskas, prepared\u00a0<a href=\"https:\/\/transparency.lt\/media\/filer_public\/2013\/06\/20\/tils_praneseju_apsaugos_istatymo_projektas_20115.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Whistleblower Protection Law Project <span class=\"filesize\">(63,3 KB)<\/span><\/a> and\u00a0\u00a0<span class=\"file\"><a href=\"https:\/\/transparency.lt\/media\/filer_public\/2013\/06\/20\/tils_pasiulymai_pai_projektui_2010_11_262.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">\u00a0Project&#8217;s Explanation <span class=\"filesize\">(109,4 KB)<\/span><\/a> <\/span>\u00a0that were submitted for amendments to various institutions, such as the Special Investigations Service (STT), the Prosecution Service, the Police Department, the State Labour Inspectorate, the State Tax Inspectorate, the Financial Crime Investigation Service and the President. It was agreed from the beginning upon that protection is vital and TI Lithuania together with various institutions were looking for the best regulatory model for whistleblower protection. On 30th of September 2010, a group of MPs called the <strong>&#8220;For c<\/strong><strong>ivic involvement in creating Lithuania without corruption&#8221;\u00a0<\/strong>unexpectedly registered the Draft law on Whistleblower Protection. The proposal received sufficiently justified constructive criticism and input from various institutions (see the documents below).<\/p>\n<p style=\"text-align: justify;\">TILC believes that the Draft Law on Whistleblower Protection registered at Seimas had the following underlying problems:<\/p>\n<p style=\"text-align: justify;\">1. The activities that could be reported\u00a0were too narrowly defined,\u00a0i.e. only corrupt activities &#8211; but not other offenses &#8211; can be reported;<\/p>\n<p style=\"text-align: justify;\">2. The list of addressees &#8211; the people and institutions that activities could be reported to &#8211; was too narrow. These only included institutions responsible for\u00a0pre-trial investigation, excluding employers as well as the State Labour Inspectorate and the State Tax Inspectorate;<\/p>\n<p style=\"text-align: justify;\">3. The application of whistleblower protection measures does not ensure adequate protection throughout &#8211; from the start of the pre-trial investigation to the end of criminal proceedings (<span class=\"plugin_link\"><a href=\"http:\/\/www.drasuszodis.lt\/userfiles\/TILS_siulymai_registruoto_ist_projekto_2010_11_22.pdf\">TILC suggestions for the Whistleblower Protection Law Project<\/a><\/span> ).<\/p>\n<p style=\"text-align: justify;\">These and other problems distort the concept of protection for whistleblowers and do not provide whistleblowers with the necessary assurances.<\/p>\n<p style=\"text-align: justify;\">The documents listed below present the views on\u00a0the regulation of whistleblower protection from both\u00a0Lithuanian institutions and foreign organizations:<\/p>\n<ul style=\"text-align: justify;\">\n<li><span class=\"plugin_link\"><a href=\"http:\/\/www.drasuszodis.lt\/userfiles\/Soc_reikalu_ir_darbo_papildomo_komiteot_isvados_2011-04-06.pdf\">LR Parliament&#8217;s Social Affairs and Labour Committee&#8217;s additional findings<\/a><\/span> ;<\/li>\n<li><span class=\"plugin_link\"><a href=\"http:\/\/www.drasuszodis.lt\/userfiles\/Nacionalinio_saugumo_ir_gynybos_papildomo_komiteto_isvados_2010.pdf\">LR Parliament&#8217;s National Security and Defense Committee&#8217;s additional findings<\/a><\/span> ;<\/li>\n<li><span class=\"plugin_link\"><a href=\"http:\/\/www.drasuszodis.lt\/userfiles\/Seimo_Antikorupcines_komisijos_isvada_2010-11-24.pdf\">LR Parliament&#8217;s Anti-corruption Commission&#8217;s findings<\/a><\/span> ;<\/li>\n<li><span class=\"plugin_link\"><a href=\"http:\/\/www.drasuszodis.lt\/userfiles\/LR_Vyriausybes_nutarimas_del_PAI_projekto_2010_11_17.pdf\">LR Governement&#8217;s ruling on the whistleblower protection law project proposal<\/a><\/span> ;<\/li>\n<li><span class=\"plugin_link\"><a href=\"http:\/\/www.drasuszodis.lt\/userfiles\/ETD_rastas_del_iregistruoto_projekto_2010-10-20.pdf\">European law department&#8217;s opinion on Whistleblower protection law project<\/a><\/span> ;<\/li>\n<li><span class=\"plugin_link\"><a href=\"http:\/\/www.drasuszodis.lt\/userfiles\/Teises_departamento_isvada_2010_10_05(1).pdf\">LR Office of the Parliament Law department&#8217;s findings<\/a><\/span> ;<\/li>\n<li><span class=\"plugin_link\"><a href=\"http:\/\/www.drasuszodis.lt\/userfiles\/STT_Isvada_del_pareiskeju_apsaugos_istatymo_2010-07-13.pdf\">Special Investigations Service&#8217;s (STT) findings regarding the laws regulating the reporting of corrupt activities, whistleblower protection, application problems and suggestions for the amplification of protection effectiveness <\/a><\/span>;<\/li>\n<li><span class=\"plugin_link\"><a href=\"http:\/\/www.drasuszodis.lt\/userfiles\/Resolution_on_the_protection_of_whistleblowers.pdf\">Transparency International resolution on the protection of whistleblowers<\/a><\/span> ;<\/li>\n<li><span class=\"plugin_link\"><a href=\"http:\/\/assembly.coe.int\/Main.asp?link=\/Documents\/AdoptedText\/ta10\/ERES1729.htm\">Resolution 1729 (2010) of the Parliamentary Assembly on the Protection of whistle-blowers, adopted on 29 April 2010<\/a><\/span> ;<\/li>\n<li><span class=\"plugin_link\"><a href=\"http:\/\/assembly.coe.int\/Main.asp?link=\/Documents\/AdoptedText\/ta10\/EREC1916.htm\">Recommendation 1916 (2010) of the Parliamentary Assembly on the Protection of whistle-blowers, adopted on 29 April 2010<\/a><\/span> ;<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Also, the resolution of LR Parliament of 16th June 2011 no.\u00a0XI-1457 confirmed the\u00a0<span class=\"plugin_link\"><a href=\"http:\/\/www.drasuszodis.lt\/userfiles\/Nacionaline_kovos_su_korupcija_programa_2011-2014.pdf\">National Fight Against Corruption Programme 2011-2014<\/a><\/span> . At part 9.3 it indicates &#8216;&lt;&#8230;&gt; Although Lithuania has adopted international laws in the area of whistleblower protection in accordance with the United Nations Convention Against Corruption (<span class=\"plugin_link\"><a href=\"http:\/\/www3.lrs.lt\/pls\/inter2\/dokpaieska.showdoc_l?p_id=289015\">\u017din, 2006, No. 136-5145<\/a><\/span> ) 33rd article (&#8216;Whistleblower Protection&#8217;) and Civil Law Conventon against Corruption(<span class=\"plugin_link\"><a href=\"http:\/\/www3.lrs.lt\/pls\/inter2\/dokpaieska.showdoc_l?p_id=197963\">\u017din, 2002, No. 126-5733)<\/a><\/span> ) 9th article (&#8216;Employee Protection&#8217;); however, the existing national regulation is not effective enough. In order to fulfill its international obligations, encourage the disclosure and investigation of unethical activities, promote more effective protection of the public interest, and ensure an efficiently running mechanism, Lithuania has to analyze and practically evaluate already existing laws, regulating the whistleblower protection.&#8217;<\/p>\n<p style=\"text-align: justify;\">This provision, on the one hand, obliges institutions to seek to establish appropriate whistleblower protection regulations. On the other hand, TI Lithuania is worried that an analogous obligation was already included in the annex of\u00a0<span class=\"plugin_link\"><a href=\"http:\/\/www.drasuszodis.lt\/userfiles\/NKKP_2008-2010(1).pdf\">2008-2009 NKKP<\/a><\/span> ,\u00a0&#8216;The implementation plan for the national fight against corruption programme 2009-2010&#8217; as measure no. 49. A further identical measure was suggested in the older version &#8211;\u00a0<span class=\"plugin_link\"><a href=\"http:\/\/www.drasuszodis.lt\/userfiles\/NKKP-2002-2007(2).pdf\">2002-2007 NKKP<\/a><\/span> , as measure no. 40. TI Lithuania carried out a survey of the internal conditions created for employee whistleblowers at LR ministries and their subordinate institutions. At the same time, exploratory research into possibilities for external reporting was carried out performed. The aim of the study was to find out how many &#8216;hotlines&#8217; were available at the national level.
